●GENERAL TERMS●

If I am unable to complete my half of the trade, I will notify you immediately. Likewise, if you are for any reason unable to complete your portion, please notify me as soon as possible.Art created by me may be posted to my social medias and will include credit to you (the collaborating artist) using live links/tags to your social media.Art traded to me may be featured on my social medias with credit to the original artist (you) using live links/tags to your social media.I may post behind the scenes content of the piece created by me (such as time lapses, process pictures, and work in progress pictures) to my Patreon as tier rewards. You are allowed to request that I do not share the behind the scenes content of the piece I create for you.Artwork traded to you may be uploaded on any website and social channels with credit to me (the artist). When crediting, please use a live link/tag to my Carrd or social media.You may NOT use my work for AI training purposes.You may NOT use my work for NFT purposes.You may NOT make profits from the traded piece (reselling, redistributing, uploading to POD-services, selling prints, etc.)You may NOT alter the traded artwork without my (the artist's) consent.You retain the rights to the intellectual property (IP).You may NOT use the traded artwork for commercial purposes.The following is considered copyright infringement:Using the copyrighted artwork for AI purposes.Using the copyrighted artwork for NFT purposes.Reproducing/using the copyrighted artwork commercially - means making money off it in any way not excluded from these terms.Claiming the artwork as your ownAltering the artwork without my consentAny unauthorized use of the artwork, including but not limited to AI training, modifying, reselling, or using as an NFT is strictly prohibited and may result in legal action.In some cases, the commercial rights to the image may be purchased.

●EXCHANGE RATES●

Reminder that this is a trade so exchanges are equivalent.
The price of a cel shaded full body character art would be a cel shaded full body character art.

●PROCESS●

Ideally, unless specified otherwise, we share watermarked, work in progress pictures throughout the process so we are comfortable knowing both parties are completing their portion before moving on to the next phase.

Terms of Service

●GENERAL TERMS●

Prices are subject to change.I have the right to reject any order for any reason.Unless agreed upon by both parties, communication will take place through Artistree.

●PAYMENT●

Transactions will be made through Artistree and Stripe.Commission must be paid 100% upfront.

●PROCESS AND DELIVERY●

The time it takes to complete your commission varies from 5-30 days depending on factors such as health, the complexity of pieces, and other work load.Once the piece is finished you will receive your files through Artistree.Note: There is no physical product.

●REVISIONS●

You get 3 rounds of changes on the commissioned piece included in the price.
(May vary depending on type and size of commission)A fee may be added if you want something changed on the final drawing - unless a misunderstanding from my side has been made.If you wish for me to change something in the drawing you have previously approved, I may charge you a fee to change it. The amount of the extra charge depends on the change you want me to make.If your reference is unclear to start with changes will come at an extra charge.

●COPYRIGHT AND USAGE●

I, PestilenceCat (the artist):I reserve the right to cancel and refund the order at any time for any reason.I retain all copyrights over the commissioned artwork.I will NOT claim the intellectual property (IP) of the commissioned artwork.I reserve the right to post the commissioned artwork online, in my portfolio as well as in publications such as art books.I reserve the right to post behind the scenes content of the commissioned piece (such as time lapses, process pictures, and work in progress pictures) to my Patreon as tier rewards. You are allowed to request that I do not share your behind the scenes content as Patreon rewards.You (the customer/commissioner):You may upload the commissioned artwork on any website and social channels with credit to me (the artist). When crediting, please use a live link/tag to my Carrd or social media.You may NOT use for AI training purposes.You may NOT use for NFT purposes.You may NOT make profits from the commissioned piece (reselling, redistributing, uploading to POD-services, make prints, etc.)You may NOT alter the commissioned artwork without my (the artist's) consent.You MAY be allowed to sell the artwork if it is a part of an Adoptable. Please discuss this with me prior to paying for the artwork.You retain the rights to the intellectual property (IP).You may NOT use the commissioned artwork for commercial purposes.The following is considered copyright infringement:Using the copyrighted artwork for AI purposes.Using the copyrighted artwork for NFT purposes.Reproducing/using the copyrighted artwork commercially - means making money off it in any way not excluded from these terms.Claiming the artwork as your ownAltering the artwork without my consentAny unauthorized use of the artwork, including but not limited to AI training, modifying, reselling, or using as an NFT is strictly prohibited and may result in legal action.In some cases, the commercial rights to the image may be purchased.

●CANCELLATION AND REFUND POLICY●

The buyer is not allowed a refund once I started working on the commission.If I receive no communication from you, after 7 days your commission will be canceled and you will not receive a refund.If for any reason I am unable to start your commission you will receive a full refund.If you cancel your order before I started it, you can get a full refund.If you are getting a refund, do not request a chargeback. Please use the "Need Help" option of the relevant commission to issue a refund request.If you request a chargeback at any point when you were not allowed to ask for a refund you will lose all beforementioned rights to the commissioned piece and I will have the full right to profit further from it in any way. I will decline the chargeback and I will open a case with Artistree. Furthermore, you will be blacklisted for commissioning me again.
